By making a Will we make a conscious decision to ensure that after our death our assets are distributed to the people (or organisations) that we have chosen to benefit from our estate. A Will comes into effect only after we have died.

A Will can be contested on a number of grounds, or be invalid, if the person who made the Will is found not to have had testamentary capacity (mental capacity) at the time of signing the Will.

If no valid Will has been made, the Law will decide in what proportion and to whom the assets of the deceased person will be distributed.
